I'm only posting a response cause my response is sad and funny at same time. No one's beat me yet???
Came in Dec 1990
Been on various visas including F1 (grad and undergrad) and H1.
Didn't get to file GC till 2007 unfortunately...
Thanks all.
I'm in my mid thirties now. I came as a teen, fifteen.
So I wonder....should the dream act come through....could it work in my favor too lol? I came through no choice of my own (though legally) with my parents....
And do i get a GC for beating everyone on here :)
j/k.
Did your parents file for GC? What is their status now?

Look at this post. The thoughts are compelling. Is this something that we should get some clarifications on?
http://immigrationvoice.org/forum/showthread.php?t=10859
It is certainly a good deal that we are able to file for 485 and we can enjoy the benefits of EAD/AP.
Mark my words...when apply to renew your EAD and you are not sure if spouse can work when one EAD has expired and the other is in the process of being approved you will realize what we are trying to say...after you keep applying to renew AP/EAD 3-4...one beings to wonder if it was all worth it.
In short, after we file our 485/EAD/APs we should work with IV and try to lobby for better laws...we should not be complacent and think our work is done, we crossed a small hurdle thats all.

H1b and GC are sponsered by employer and they have to pay. If employer asks employee to pay the expenses then that company is not legitimate and persons should avoid joining those companies. Most reputed companies will pay all the expenses of GC and H1b. Some will ask employees to pay for dependents EAD,AP etc.
Consulting companies ask employees to pay GC and H1b if employees want to work hourly. That means employees wanted more money and they are taking risk(Also working hourly is against the H1b regulations as they have more chance for falling out of status).
I tend to disagree with that. You are partly right that H1B cost should be borne by the employer. There are DOL regulations for that you can easily find on the web.
For GC, you are partly right in the sense that only the first stage - Labor Certification should be completely borne by the employer. DOL released the regulation last year w.e.f. July 16 2007. The second and third stage however, I-140 and I-485, are of no concern. That is, there is no law which says that Employer should borne the cost for that. Even in reputed companies, the employees pay the cost for I-140/485.
Thanks.

thats one way to look at it. The other way to see this is that:
- given enough people making noise its possible to get DOS/USCIS to make changes and fix things. this has now been proven.
-there is a lot more visibility for EB related issues now, so much better chance of recapture or exemption for spouses from VB calculations etc.
- instead of focus being on filing 485 without visa numbers (which is what IV focussed on for a while) everyone will now focus right at the root of the problem. All 500K are now focussed on solving the main issue.
My friend, there is validity in what you say. I think there is a general shortage of visas, period. That is the root of the issue. However, we did know that going in. So when we get stuck in that situation we have to remember to distinguish between calling for change and demanding it.
Also, with all due respect to IV, I think the thing that most likely led to the USCIS turnaround was not our voices, but rather the fact that a law suit would have revealed SERIOUS rule breaking - particularly with regard to issuing of visas to non-security cleared people. I think the USCIS's fear of dealing with a) discovery during court proceedings and b) potentially huge finanicial damages, were the main motivating factors to the turnaround.
There is no doubt though, that the voices of immigrants did make a difference.
By the way, this morning I wrote to both Senators Cornyn (for) and Clinton (against) in response to their amendment votes yesterday. I thanked him from trying to bring relief and urged her to show more bravery in solving the crisis at a future opportunity. I urge you all to do the same.

I agree with you 100%.
The material damages to would-be July filers are a travesty. That is undeniable and deserves, at the minimum, material compensation.
But making the bulletins current in the first place, instead of a making a measured movement in the priority dates was like trying to fill a glass of water with a firehose. Broken glass and severe water damage were sure to follow.
Man, in frustration people do not even know what to say and what not! Be very careful of what you spin and what you say. From the looks of it, this stuff has every chance of spinning out of control and it may have already started the ball rolling.Think about it for a second!. Once it goes that way, trust me, we will all live to regret that.
Yes, DHS approved upwards of 25000 GCs over the weekend, leading up to July 2nd. And some people are pissed off at that, err..why?
Remember, those 25000 are one of us. Once, they too were in line for Labor certifications, I-140s, medical exams and all that crap. And some of them were in the so called "FBI Name check" black-hole for an extended period of time. We should be rejoicing in the fact that most of those backlogs got cleaned up. Instead we have people questioning the validity of those newly approved GCs.My dear friends, god willing, we will all have GCs one day and tell me, how would you feel if someone else comes screaming at you just because he did not get one too.
Putting a "security lapse" spin on this could be very dangerous and should be avoided at any cost. I hope one of those anti-immigrant lobbies do not pick it up and start running with that. I prey that they do not revoke those already approved GCs, because if they do, then those poor 25000 souls will go through much more agony than what we are going through now.
It's very tough to get the genie back in the bottle once it is out, so think before you start popping that cork.

Your PD in EB3 for ROW will be back into track in October 2008 as its said in the current visa bulletin dated Jul 2008 for EB3 preference. So once it is back to current in October then the new visa numbers will be alloted. Then you will get your GC. So just wait till October to receive your GC confirmation.
Good Luck!!!
Thnk you, Vdlrao, and other members for response to my question. They were very encouraging. I am grateful to have this IV community to provide and seek support.

Well said ..I totally agree with you....they would get their $400 million instantly..
I think the companies will slightly increase the billing rate, cut down on some expenses and bite the bullet to some extent.
Schumer is clear - he wants the money, he doesn't want Infy, TCS to leave USA.

For all those people who are gun shy, let me assure you, it does not harm anybody. On the contrary it is helpful to all of us. Please consider pulling the trigger. The fund drive that is happening today is not the last drive; as long as we are active, their will always be fund drives. Maybe you are thinking of contributing after seeing the effects/results of Sept 18th. In that case, I urge you to contribute now to get the maximum bang for your buck. Think about the Macys firework in New York. It will be rather boring to see them light one fire work each night during the month of July, just because funds did not arrive in time or were slow to arrive. Sept 18th is our 4th of July. Please make your contributions esp. if this is your first time. Contribute so IV can pay for all the items in their list and make this firework really bright.

all i can say is lets hope that this time next year we are still not debating about this.
if lobbying alone works and gets our job doen thats fantastic. then there is no reason to do anything else. why even bother to get media attention, put up posters, have state chapters, etc?
agree. lobbying alone is not gonna work. we need some brainstorming....

One one hand you have folks who are getting labor approvals from BECs just now and have not filed I-140s.
On other hand you have PERM folks who have Labor, I-140 certified in 2 weeks.
Don't you think this provision is a bit harsh on those who've waited 3+ years for labor in BECs ?
Not a bit harsh but very harsh. There are cases of people who have waited for 5 years and are still stuck in BEC. Now if this bill passes, they will have to apply all over again. There are also people who have gone through the PERM process and have not applied I140. Sometimes PERM process can take upto 1 year if the HR and Lawyer is slow in the recruitment process and unresponsive.

ok...I am trying really hard to understand what you are trying to convey. What is your concern ? People will stop visiting IV and go to other websites ?
No need to be over-dramatic (did not read any one calling you a traitor). People talk about going back to their home countries too (but I actually see a small fraction of people actually doing it).
I am not sure you understand the concept of an organization offering 'services' to its members. X man hours to produce ? what are you talking about ?
My friend it is not just 'information'. Information is money. All you are talking about is 'forums/discussion boards'. I have mentioned this before as well. IV is more than a discussion board and you can make no comparison to other tracker websites.
Here is some additional info about non-profit orgs. You SHOULD read about non-profit orgs in the below link:
http://en.wikipedia.org/wiki/Non-profit
So your definition of support is 'monetary support' only?
I am sorry for being so critical, but then someone has to.
If the idea of monetary only threads is to affirm the show of support, than am i a traitor to the greater good of retrogressed non-immigrants? This is not the right way to go.
Donors here on this very thread have already started talking about people spilling over to sites like and also if members might float other immigration websites.
why are we doing this? Why are we creating differences?
What is the Donor only thread? is it a commodity, that took 'x' man hours to produce, that you are charging money for it?
It is information. period. and as every hour passes, more organisations are providing or striving to provide information free of cost.
Also, what are we discussing in these threads, that we have to be paid members to view it?
Have you even thought about this legally?
Usually, a non-for-proft org has a fund raiser or a money raiser drive or event.
How are you even justifying asking for money to view threads, which is nothing but information that you do not own and have not worked to get it.
Believe me, this is walking on a very thin line.

Guys...digg this one religously..
For the first time one article connects our needs to what Americans are interested in; Homeland security.
Guys, not to say that they should approve cases without background check but are you sure this will not turn against us if they associate USCIS being efficient (approving cases faster) with them taking shortcuts and give GC to people who are a threat ??
Everybody here wants some of those "reserved" (already taken for cases not yet approved) visas to be available again but nobody thinks what this will do to us in the long run because some might read the news and conclude that USCIS just gives green cards to people that might be a threat.
As for my angle on this, I did not file yet so I have no case pending waiting to be approved....
:(
