Hi

I just checked my status on line and saw a LUD on my and my wife's pending 485 applications. My priority date is March 2006.

One reason that I am thinking off is that i had a service request opened on 8/22 when i went for infopass appointment and I recd a letter from USCIS dated Sept 30th with the usual template of saying that "we are processing your application bla bl bla and if you dont hear anything from us in 6 months please call us bla bla bla....."

However the LUD is not 9/30 but 10/7. I am wondering if anyone else has seen LUDs on their applications.

My AP and EAD have been renewed long back (about 1 month back).

Any response in this respect is appreciated

Hi,

I was on H1 VISA when my wife came here on H4 VISA. When I was filled her DS-157 form for H4 Stamping by mistake I put the wrong dates of employment.

Now she got her H1 Visa approved when she was here in US. She is going for H1 Visa stamping . She is filling her DS-157 again with the correct dates. Would it be a problem. Would H4 DS-157 be tied back to DS-157 for H1 while she is there for H1 Stamping.

Please any help would be appreciated.

I have 2 questions.

- With the PD becoming current, my wife's 485 will get applied anytime within the next month or so by her company lawyers. My GC is just about to be started. I will be adding my name to the 485 application of my wife. Does my GC application date has to do anything with this? I mean if my GC is applied before my wife's 485 (and my name added) or after my wife's 485(my name added), does it have any affect on either one's processing?
- Another question is does the H1-B extention for 3 years can happen after I-140 application or I-140 approval?

If it was filed in the EB2 category, it is likely that they picked the case for a random audit. EB2 labors do get audited during PERM processing to ensure that the case does meet eligibility requirements for EB2. There is no clear pattern to this auditing though, some cases get audited and some do not.

Category classification of EB2 or EB3 is done when filing I-140. Labor does not have any such classification. It all depends on the job requirement that decides EB2/EB3 at I-140 while filing.

I am curently on h1b visa on 7th year.My i-140 got approved 3years back and filed i-485 in 2007 and waiting for gc.Now if i switch my job to different employer using my EAD,Can my previous employer revoke my i-140 affecting my gc processing.Does he still have control to withdraw.Can you please help on this.Thanks.
Employer can withdraw anytime. But you should be OK with AC21 provisions.

I was checking the http://congress.org

I noticed they have a Calls to Action from Groups and Organization on the home page, When i tried to see if there are any Immigration related issues posted There were many like increasing H2A etc but nothing corresponding to Retrogression or GC waiting faced by thousands of immigrants.

There are 100s of bills waiting for Co-sponsors published on this website.

I felt we should do post about the issues faced by Thousands of Legal immigrants who are struck in retrogression or Per country limit.

This may be a good place to put as a number of representatives may view it and it is a good way for us to let the people know of the issues.

Rediculous, the processing times say it takes 90 days minimum. hopefully they will give the extension from my expiry date which is Aug 28th 2008.

I first off apologize if there is already a thread pertaining to my questions. If so I would greatly appreciate being directed.
My situation is this...I came to the US as a visitor from Canada. As a result I did not need a I-94, a visa or a passport since i travelled by car. I am going to be married to a US citizen in a couple of weeks. I guess my questions are these...#1. Since I did not need any of those documents to enter the US, will this cause a problem while trying to prove status?
#2. I read somewhere about filing a I-30 prior to other documentation such as the I-485 and medical and so on. I was wondering if this is true or if i even need to file this document or if so if it can be filed in conjunction with the others.

My wife is currently on a B1/B2 status which is valid for 10 years. She has an appointment to get her H4 stamped next week. Can she have both the B1/B2 and H4 visa stamps at the same time or will they "Cancel without prejudice" the B1/B2 after the H4 is stamped?

Is there a way to request the consulate not to cancel the B1/B2 visa?

I came to US on a L1 Visa, changed jobs got a H1 visa but never left the country for the last 3 years so dont have a H1 stamping in my passport.
I will be getting my 7th year extension (probably 3 yrs based on my approved I-140) soon and i have to visit India atleast this year. With no hopes of 485 filing and absolutely no hopes for CIR i need to plan to get a Visa stamping in my passport.

With the Interview dates at US Embassy in Chennai already gone till December First week, do you know whether i can get my H1 stamping done in any of the Canadian Embassies?

Has anybody whose case is similar to mine got their stamping done in Canada? Advice me on any risks.

Hi Guru's,

I am currently in INDIA and applying for my H1. I have a couple of questions regarding this:
Back Ground:

1. My husband and myself are applying for H1 B.
2. Company A is sponsoring H1 for my husband and company B is applying for H1 for me.

Q & A:

1. As H1 B is lottery system this time too, we both are applying for H1. Is it possible that, if both of us get H1's, can I still enter into US on H4 status and later convert to H1.

Trying to help Mother-In-Law over from China for visit. Unsuccessful w/ tourist Visa process, so now going for Green Card. Received Notice of Decision against me, unable to establish my Petitioner wife is daughter of Beneficiary Mother-In-Law. No hospital records. Previous evidence was "Notarial Certificate of Relationship." I have just received new evidence "Notarial Certificate of Birth" from civil authorities - along with affidavit from school teacher - I need to file EOIR-29, I think to call it APPEAL, OR IN THE ALTERNATIVE, MOTION TO RECONSIDER - can anyone provide a "go-by" as to what format my letter should take? Is letter format acceptable or is formal pleading format needed?

Time is of the essence, I have to file within 24 hours or give up and pursue DNA testing....

Do you think the lottery will take place for 2010 year H-1B filing?

zero I think...
H1 filing follows the general employment scene, and with the current employment levels, and the relatively low levels of recovery being seen so far, the chance of a lottery seems almost nil....
H1s for last year ran out just last week, why would 65k cases show up within a day just 3 months later?
However I dont expect it to last till December 2010 like it did this year. Employment is going to slowly improve going forward, TARP H1 hiring restrictons dont apply to many banks...

Hi!

I need to know when can I fly back to US on my H4 visa(valid till 2011 ).
My husband has joined a new job and his H1 B transfer has been filed .
Do I have to wait for new I 797 or Can I just travel on my old H4 visa and
visa transfer receipt notice .( he is filing the H1 transfer by premium processing ) .
His new employer is suggesting me to reenter on old h4 and before my husband
joins their company .
But for me that will be very soon ( not fulfilling the purpose of my visit ).

Hi,

Ist case:
I applied GC for me and my spouse thro' EB3, AOS in July 2007, with Priority date 2005.
Currently I am in H1B and my spouse uses EAD to work.

2nd case:
My spouse applied the labor process and planning to apply I-140 in EB2 and choose CP process , once Labor approved.

Question:

For Spouse:
Is it possible to use EAD (1st case, as benificiary) to work and go for CP in 2nd case (Primary)?.

For me:
Can I add my name in CP (as Benificiary), with out effecting the my process AOS/H1B (1st case)

Hello,

I am holding a valid H1-B visa which was stamped in 2007. But before i could make my travel plan i could see recession hitting US and people out of jobs. This made me to hold back my job at home instead of quitting in a hurry.

Now i am based in UK on an assignment and i would like to VISIT USA as a TOURIST for 4 weeks to see my brother.

1) Am i allowed to visit as a visitor ?
2) Can i still hold H1-b visa active without being cancelled ?

Hello,

Here is my situation :

1) Labor filed in EB3 in June 2004. The labor was filed in non-PERM and approved. I-140 was filed in Aug 2007 and it is approved in Dec 2008 with Priority date of June 2004

2) Labor filed in EB3 with same company in May 2006 through PERM. Got approved in 2 months and I-140 applied and approved within 12 months in April 2007. Priority date is May 2006. Applied for 485 in Aug 2007 and have EAD/AP based on it.

I am no longer with the company (quit after 180 days after 485 was applied) and am working for another company on H1B using AC21.

Question is, can I port priority date for 485 processing from May 2006 to June 2004 in my case where I have changed employer. Note that by time June 2004 I-140 is approved, I am no longer with that company.

CF card speed does matter, particularly if you shoot RAW or use the motor drive. Even going from a 24X card to a Sandisk Ultra II was amazing. Stay away from the low write speed cards.
