A study done last year by the U.S. Citizenship and Immigration Service ("USCIS") found as many as one-in-five H-1B applications were affected by either fraud or "technical violations," of the H-1B program. This may be the impetus behind USCIS increased anti-fraud enforcement efforts. Whatever the reason behind such stepped-up efforts, there is no doubt that the USCIS has begun making more and more "surprise visits" to the U.S. work sites of companies that sponsor H-1B visa holders. The Office of Fraud Detection and National Security ("FDNS"), a division housed within USCIS National Security and Records Verification Directorate, was created in...

From the Immigration Policy Center: Supreme Court Protects Immigrants' Access to Court Review January 20, 2010 Washington D.C. - The American Immigration Council applauds today's U.S. Supreme Court decision ensuring that immigrants facing deportation have fair process in the review of their cases. The Court ruled that individuals who seek to reopen their deportation orders have the right to appeal to the federal courts if the immigration court refuses to hear the appeal. The Court's decision protects immigrants' access to federal court review and affirms the role of the courts in our system of checks and balances on government power....

Bill Gates to appear before congress on March 12, I know it is not easy to approach him and seek his help for our cause in a short time...but felt throwing this idea is not a bad idea....
Anybody know Mr.Gates ?

you can claim him if:
1) He didn't earn more than $3500 in 2010
2) You have proof of providing more than 50% of his expenses (ie. paid his tuition etc.)
3) He was in the US for more than 180 days in 2010 (ie. US resident for tax purposes)
If you paid for his tuition, you may be able to claim tuition credits for him too.

Hi All,
I fulfill the requirements of AC 21 (485 pending for more then 2 years and I 140 approved long back)
My current project is not my employer's client. There is one middle vendor from which I have got this project.
Now, I have heard that many consulting companies make you sign a contract which states that any client you find becomes their client and therefore forbidding you to join them directly. As we usually dont see papers while signing I am not sure if I did sign any such thing. My question is, if my employer sues me on this clause, does it hamper my I-485 processing? Any input in this context would be highly appreciated.Tension is killing me
Priya.

My wife was on f1 status when we filed for 485.
We went to india this last december and used AP, no issues what so ever.
Make sure you do provide the old 94 to airlines before leaving US.
relax and enjoy you trip.

Please let me know!!
I think you can log on to uscis.gov and check the case status for receipt number, always good to add this receipt number to your account (User Account) where you can track your portfolio.

Check out questions for DOL and DHS
Does Senate answer questions posted on website of a lawyer?
When are the answers expected? Can someone find out from the lawyer. It is better for us to know the answers than the questions.

Hi
I'm self filing my EAD renewal and needed help filling out form I-765.
Question 11: Dates of prior EAD.
Do they expect the dates of all previous EAD applications or just the last one?
Question 12: Date of Last Entry into the U.S.
Question 13: Place of Last Entry into the U.S.
I recently went on a short trip to Canada and I didn't receive a new I-94 on my entry back by road via Buffalo,NY. Prior to that, I entered the US on H1B via SFO.
How should I answer this one? SFO or Buffalo,NY?
I live in California. Where do I mail the I-765 application?
Thanks!

Attorneys please advice on my case below....
I applied for an I-485 during July Fiasco under EB3 category with an approved I-140(EB3). EB3 priority date is October 2005.
I also started another process later in EB2 category with same employer. My EB2 I-140 finally got approved recently and successfully porting the priority date from EB3 but did not file for I-485 in Eb2 yet.
Last week, my EB3 I-485 petition got approved even though my EB3 prority date is not current. I have got my welcome letter (I-797C) today. The COA is 26 on the notice.
My questions are:
Is it approved by error?
What are the risks involved for now and down the road.
Can we travel outside United States using this GC.
Will appreciate any advice.

I just posted a ton of photos
Just thought you might want to check out a few photos I took of Green Day (direct link below).
I kind of went over and posted too many (67) .
Check'em out!
I'm also taken photo in Indy of them.

Anything you like in there? Let me know.
I only had one lens with me that night my canon 70-200mm 2.8L
I'm not really used to shooting shows with just that lens, but I think I got a couple of keepers (well I think):o

I am working for a MNC and I got L1 visa stamped. After marriage I got my H4 visa stamped.(After L1 stamping) But the Visa officials have not marked the L1 visa cancelled in the passport, does it mean that the Visa is still valid? Does that mean that i can still travel on my L1 visa?
If your L1 petition is still valid (not withdrawn by employer) and you intend to work for that employer (ie. fullfill all other L1 requirements) then yes, you can still travel on L1 and maintain L1 status in the US.
