Hi,
My i140 was approved 2 months back and now i got a Full time position in another company.
So my question is, after moving to new company if the dates are made current can i still file for i485 with my old employer if he agrees for it?

Maybe few visas might get rejected because they would have tried to stay in USA permanently. Yes, you may apply for L1 visa extension using Form I-129, and L Supplement. Extensions of two years at a time may be allowed until you have been in the U.S. for a total of seven years if you are a manager or executive.

I have worked for Company "A"(Ex-employer) under H1-B(company A holding my H1-b) from 2007-2010. During 2009 & 2010, company A was unable to clear all my payments as the company went through some financial hurdles but they issued W-2 for the amount paid in fiscal year 2009. Now, company A has got money and they decided to clear my back wages for 2009-2010 through 1099 form. I transferred my H1-B visa to Company B(2010) then to Company C(current employer). Now, Company C has started my Green card(GC) process.
Questions:
1. I already received W2 for 2009. Can company A amend the W2 for the back wages?
2. Is it legal to take the unpaid amount under 1099? Will it affect my GC process?
3. What are my options to get my back wages from company A?
4. Company A want to issue 1099 along with a letter stating that i was full time employee for the time period mentioned in 1099. Is it acceptable?
I really appreciate your help for taking your valuable time in clarifying my questions. I look forward for your reply.

My visa H1-B nd h4 visa was expired on june 30 2010. I have got an job offer and they filed my H1-B petition after july 20 2010. I have submitted my I140 and mine & my wife I485 applications in EB1 category on Feb 22 2010. The gap between the H1b process is nearly 20 days period. The USCIS has approved my H1 but my wife's H4 was denied.
Here is my question. Whether they would have kept the I-94 for me. How can we proceed with H4 denial situation. Please give me some suggesion

It seems quite a few individuals with older priority dates from 2003 & 2004 are still waiting for a decision on their RiR cases (both state and regional) from Dallas BEC. It has been recently reported that many of these cases have received RFE's from BEC on a variety of issues (they might also have had an RFE at state or regional). I think it would be advantageous for all of us in similar situation if we can anonymously post the type of RFE's we receive and possible ramifactions for the same.
If some one knows of a similar thread elsewhere please provide a link, that way we can avoid duplicates.

If my extension is rejected, I understand that I can apply for H4. (Since my husband is on H1)

Hi - I am currently on an L1 blanket visa and it looks like my company will sell the unit I work for in the US. The parent company will sell the US division - I am currently in the process of applying for my GC - with the I40, and I485 both pending. I had my biometrics done today.
Want to gain some views on what my options are if the GC route does not pan out. I am on a UK passport, and would like to remain in the states. The GC is an employment based application - which is apparently quick, but I want to have a plan B. Is the next best option the H1B, and if so, will I be able to apply for this (if needs be) inside the US with another company if they are prepared to take me on?
