Today I rceived someone else's EAD. We received three EADs, one each for me and my wife and another adressed to me with EAD inside being some one else's.
Weired ways of USCIS!!!!
I shall call USCIS and notify them of this.

New filing fees were applicable from 7/30. Do all applications(485/131/765) whose PD is current need to filed with the new fees starting from 7/30? Or till 8/17 it can be filed with the old fees?

Hi All,
Would request any answers or any practical experiences in regards to my queries:
My wife and my infant daughter originally came to the US in 2004 on H4 and my wife got her H1-B also in 2004.
In Oct 2007 I and my wife got our EAD (The GC processing is through my company). Also since our arrival to the US in 2004 we did not go to India . But we are planning to go this summer.
My queries: We are planning to use AP to enter US

What will be my status once I come back from India. Can I maintain H1B Status without going for stamping since I changed my company. to enter US

Hi,
Can anyone help me know of a process by which I can get my duplicate W2 form. The scenario is that I asked my employer to send me the W2 form and they say they did send it via post. But I did not receive it. Also my employer says they have not received it back. I need to file my taxes(Fortunately I had applied for extention) and don't have a W2 to attach with it. Can anybody help me with knowing the process

With the current market crisis, you never know when you will be out of job.
Though I have my H1B valid till 2011( my I140 is approved and is already over more than six months, 485 is pending), Most of the people suggesting me to apply for EAD.
1) What are the procedures I have to maintain ( in connection to USCIS and my green card application pending) if I change employer?
2)Can I also work for multiple employers on EAD?

I am currently on L2 visa with EAD and working for a company as direct employee. My wife is in L1. Both of our visas,I-94 and my EAD are valid till OCT-2010.
My wife has to go back to India as her current project is over.
My question is can a L2 visa holder with EAD stay back and continue working in U.S.A, after L1 has left the country ?.
Any information regarding this is highly appreciated.

I have applied for GC in Aug '07. I recently renewed my H1-B (7th year). I noticed that there is a mistake in the A# of my Green card application (Beneficiary #) on the H1-B approval notice.
Has any one else had this happen? Does any one know what can be done regarding this?

I would like to have a list of documents/forms needed to file for derivative I-485 for spouse.
I did come across a few lists on the web, some overlap and some don't, but they do not necessarily address the full list of documents needed when Primary's I-485 is already pending and spouse is filing separately at a later time.
The derivative beneficiary is already in US on a dependent Visa, looking to do AOS instead of CP.
I would appreciate if anyone can provide a list and it'll be great if any members in a similar situation have done it themselves.

Has the PERM Processing slowed down? My company applied for me on March 1st and I have not heard anything till now. When I see online in tracking websites I do not see any approvals for others too. Any thoughts on whats going on friends.

All the while we saw people talk about new job matching LC job and not H1 (LCA) job. But it would be nice and safe if you have similar job on LC,LCA, new AC21 job. But mainly the job in LC should be considered as per my knowledge.

Hi,
Thanks for my previous response. I am on H1B and between projects. I have an offer to work for a couple of days for a company other than the one holding my H1B. They said they are not gonna report to the IRS as its an hourly job for 2 days and the number of hours are not going to accumulate enough for the IRS. But they need my SSN or tax-payer ID to run their payroll. I am gonna receive my dues as a simple check (like a rebate check with just the total amount showing up & NOT a paystub). Please let me know if I can work for them or not.

A hypothetical question: if I discontinue my current employment, how soon will I need to get a new job/offer in order to continue the I-485 adjustment status? Currently I-485 is pending for more than 180 days.

I have I-140 approved with PD of Aug-2007. I-485 is not yet applied. My 6 years on H1b are over. I got 3 more years of extension till 2011 on H1B based on I-140. I have also got the extended H1b (till 2011) stamped on my passport. Now I am looking to change my company before lay offs happen.
What are my options :
1. Can the new company transfer my H1B and I-140 ?
2. If they can just transfer my H1B, what happens to my PD of I-140 ? And what I may need to provide or tell the new company in case of transfer ?
3. How many years of maximum extension should I expect from the new company on H1B ?
4. Do the new company has to start GC processing ASAP ?

My current H1 is valid for 8 more months and I will have 1 more year after that to finish my initial 6 years, that gives me about 1 year 8 months before I exhaust the 6 year limit.
My question is if I change jobs and an H1 transfer is requested right now....will the transferrred H1 be valid for only 8 months ? or will I get a new I797 with 20 months validity? Help if some one knowledgeable about the issue would comment

This is for my wife. Her 485 is pending with TSC. PD is EB2 India March 15 2004. Has been current since September 1. After the USCIS website update recently received Document production or Oath Ceremony status update online. And message saying a document has been sent etc.
Since she was current we thought it might be good. 30 days later nothing received. Raised SR since we didnt receive anything. The customer service rep as usual didnt know anything. Said they haldn't received anything back. They opened SR. We got response 3 weeks later.
In the response letter it says that another notice will be forthcoming to tell you to go to local ASC.
Havent received anything. Do you think right now should I again pursue after them by writing to Ombudsman etc especially since case is current? Mainly I am afraid that since the status says Document production would some IO think that the case is already approved and so stop working on that case? Please advice. Thanks in advance.

I am being told by my employer that Prevailing wage applies for the hours from the start of an employment to the end of the year irrespective of any vacations.
I joined my current company in Feb 2010 and went to India for 1.5 months in Oct-Nov and came back, My prevailing wage hours is calculated from Feb 2010 till the end of the year ignoring the break I took when in India. So, even if I am paid for only the hours I worked here, I have to match the Prevailing wages based upon the hrs from Feb 10 till Dec end 2010.
They want me to pay them the difference as I had a low billing rate and my total earning is lower than the prevailing wage based upon this calculation.
I don't see sufficient information on the web for this clause.
Please help.
