As the prospects for Immigration reform are becoming more of a reality, so does the debate about illegal Immigration is more real than ever. A story just came in from CNN an Arizona man caught leaving water bottles in the desert for illegal immigrants has been sentenced to 300 hours of community service and a year of probation.

We like to share that the H1B cap is extremely close to being reached. The count as of December 15, 2009 is 64,200. This is 1300 cases more than the count from December 11th. This count is very close to the total cap of 65,000 which is actually somewhat reduced by numbers allocated under trade agreements. We continue to watch this very closely, and will provide updates until the FY 2010 cap is reached.
We suggest to act quickly to avoid last minute embarrassment as H-1B Cap may soon be cease to exist.

I transfer my H1B to company B and works for company B. Now suppose if I want to go back to company A after six months and want to work for company A, does the h1b transfer required? (means, does company A requires to file whole h1b petition again?) Here my petition (I-797) with company A is still valid. And suppose if I want to go back to company A after 4 years, at that time my petition (I-797) with company A might be expired, does the company A requires to file new petition (tranfer) or just the extension?

Gurus,
To all those who have received the FP notices,are your I-485 dates current for Processing ? or you have received these notices after the lapsing of the earlier FP ??
I have done one FP initially when my Case was filed.Its been long since the validity of that FP has lapsed. Should i be expecting another FP notice??
Is fresh FP notice being sent to all those whose FP validity has expired? or are they doing that in a random manner ??

Yes. The old labor is valid for 180 days after July 16th.
If your lawyer can establish that A is still alive in some form, then this is possible. The new avatar of A (B or AB) can apply for 140.

Hello,
I am on my OPT (started on 5th Jan 2009) currently and am working for a startup company. However, I am told that the company has funds only to support my position for another 2 months or so.
But the company is ready to sponsor my H1B for April 1st this year to help me keep my immigration status. My question is if my H1B application is approved this year but I loose the job before the H1B kicks in (1st October 2009) can the approved H1B be transferred to a new company, if I get another job?

Hello,
I am a canadian of Indian Origin.I was granted US Immigrant visa under the EB3 category at the Montreal US consulate in 2004.At that time I could not take my family for the interview and we chose to take their Visa later.after 5 years now we have decided to move to US (I am on commuters GC now) and has been trying for an appointment for my family at the consulate in Montreal.The consulate has informed me couple months back that there is no visa number available and my priority date is also not current (our priority date is Mar 2002).Is there any way out of this as I read now that the priority date is stuck in 2001 for a few years now and there is no real chance of moving ahead any time soon.I realise now that maybe we should all have taken the visa at that time instead of just me.Now I am stuck , is there no special case for my type of case as I had already been granted Visa earlier or since My case was already approved in 2004? I will appreciate any help or advise.

I got my 140 approved and my 6 yr H1 gets over in Jan 2010.
Could someone tell me whn is the earliest I can apply for my 3 yr extension??
And is there a time period before you have to apply for the extension?

I just had a consultation this week with an engineer working on an H-1B for several years with one of America's best known companies. The Administrative Appeals Office (AAO) Processing Times were released with processing dates as of July 1, 2010.
If you filed an appeal, please review the links below to determine the applicable processing time associated with your particular case.

The current processing time for an I-129 H-1B Appeal is 12 months. The current processing time for an I-140 EB2 Appeal for an Advanced Degree Professional is 24 months; for an I-140EB3 Appeal for a Skilled or Professional Worker is 25 months.
Most other cases are within USCIS's processing time goal of 6 months or less.
